Tree and shrub removal permit

LEGAL BASIS

Article 83(1) and (4) of the Act of 16 April 2004 on nature protection (consolidated text: Journal of Laws of 2009 No 151, item 1220, as amended).

APPLICATION

Investors should file applications for issuance of the tree and shrub removal permit in the General Office of Będzin City Hall at ul. 11 Listopada 20.

The unit of Będzin City Hall responsible for issuance of the permit is the Landscape Development Department (Room 124, tel. 32 267-91-98, +48 32 267-91-20, e-mail: ekologia@um.bedzin.pl).

In the application the investor must specify, among other things, a legal title for the real property (the requirement does not apply to the application submitted by an owner of the equipment referred to in Article 49 Section 1 of the Civil Code), name of the species of a tree or shrub, perimeter of the tree trunk measured at the height of 130 cm or dimensions of the area from which shrubs will be removed, consent of a plot owner for removal of a tree or shrub – if the user of the plot is not its owner or perpetual usufructuary, drawing or map determining location of a tree or shrub within the plot limits and in relation to civil structures existing or being constructed on the plot, function of the land where a tree or shrub grows, cause and date of planned removal

CHARGES

1. Exempted from stamp duty pursuant to the Act of 16 November 2006 on stamp duty (Journal of Laws of 2006 No 225, item 1635, as amended).
2. Fees for removal of a tree or shrub are paid by a property owner pursuant to the Act of 16 April 2004 on nature protection (consolidated text: Journal of Laws of 2009 No 151, item 1220, as amended), including secondary legislation.
